Hospital rules for patients and visitors

Preamble

The provisions of these House Rules apply to all patients from the time they are admitted to Klinik Manhagen. They become binding on visitors and all other persons when they enter the hospital grounds. The House Rules are intended to maintain safety and order so that patients can be cared for without disruption and in a harmonious environment, and to ensure the safe operation of Klinik Manhagen’s facilities, apparatus, equipment and machinery. In accordance with Klinik Manhagen’s General Terms and Conditions, the House Rules form part of the treatment contract. Visitors and other persons are informed of the House Rules by clearly visible notices when entering the hospital grounds.

Section 1 General obligations

1. In the interests of all patients, everyone staying at the hospital must show particular consideration and understanding.

2. Unnecessary noise must be avoided throughout the hospital. Quiet hours are from 10:00 p.m. to 6:00 a.m. Visitors are not permitted during these hours.

3. Instructions issued by doctors, nursing staff and the administration must be followed.

4. Alcohol may jeopardise the success of treatment. The attending doctor may therefore prohibit the consumption of alcoholic beverages.

5. Smoking is prohibited throughout the hospital.

6. Due to the increased risk of fire, naked flames, including lit candles, and the use of private heating or cooking appliances are prohibited inside the hospital.

7. The use of drugs is strictly prohibited inside Klinik Manhagen and on the hospital grounds.

8. The German Road Traffic Regulations apply on the hospital grounds. Vehicles may be parked only in designated spaces. Vehicles parked unlawfully in parks or no-parking zones, particularly in access routes for emergency services or the fire brigade, will be towed at the owner’s expense in the interests of patient safety and reliable patient care.

9. Commercial or disruptive activities are prohibited throughout the hospital. Exceptions require permission from the hospital management.

10. For hygiene reasons, potted plants and animals are generally not permitted. The presence of assistance or therapy animals, such as guide dogs, must be agreed with the hospital management.

11. In the event of a fire risk or any other emergency, instructions issued by hospital staff must be followed without exception. Emergency response measures must not be obstructed.

Section 2 Photography, filming and media

1. The hospital is not a public space; it is a protected environment designed to safeguard those within it. Special legal provisions apply here, including the General Data Protection Regulation, other data protection legislation and Section 201a of the German Criminal Code concerning violations of the highly personal sphere of life. Patients must therefore not be photographed or filmed without their prior consent, even if the recordings are intended to be anonymised afterwards. Different standards apply to patient interviews and recordings on hospital grounds and in hospital buildings than in public spaces. It cannot be assumed that a patient is able to exercise their right to object to a recording or conversation. The after-effects or influence of anaesthetic or other medication, or a lack of legal capacity for other reasons, must always be taken into account in a hospital. Photographs and audio or video recordings intended for business or commercial purposes or for publication are permitted only with the prior approval of the hospital management. This also applies to recordings made by patients or their relatives. Such recordings are likewise prohibited without prior approval, subject to the exception in item 3 below.

2. 3. 4. Photography and filming are permitted only for patients and their relatives and exclusively for private, personal purposes. No other person, especially another patient, may be filmed or photographed. For the reasons stated above, journalists may not enter the hospital, the hospital grounds or approach hospital patients without prior permission for research or reporting purposes. Journalists who approach a patient, visitor or member of staff on the hospital grounds in the course of their work must identify themselves as journalists beforehand. For security reasons, video surveillance cameras are installed in various designated areas of the hospital. They serve to protect patients, visitors, staff and property.

Section 3 Special rules for patients

1. Patients may remain only in areas of the hospital and hospital grounds that are freely accessible.

2. Patient rooms are allocated by Bed Management.

3. Appropriate clothing must be worn outside the patient room.

4. Patients wishing to leave the hospital grounds temporarily require permission from the attending doctor and must notify the nursing staff responsible for them. The hospital accepts no liability for loss or damage suffered by a patient while outside the hospital unless caused by gross negligence or wilful misconduct on the part of hospital staff.

5. Patients with infectious diseases may leave their room only with a doctor’s permission and in compliance with the measures ordered.

6. Meals for patients and accompanying persons are provided in accordance with Klinik Manhagen’s general menu.

7. For hygiene reasons, food requiring refrigeration must not be stored in patient rooms.

8. Every patient must comply with disinfection and isolation measures ordered for their treatment or to prevent infection.

9. Media devices must be used in a way that does not disturb other patients.

10. Mail addressed to patients is received by the administration and delivered to the patient. Items requiring confirmation of receipt are handled in accordance with postal regulations.

11. On discharge, all equipment provided, borrowed books and any other hospital property must be returned to the hospital.

Section 4 Special rules for visitors

1. Persons who are intoxicated or under the influence of drugs may be refused access to the hospital grounds and facilities.

2. Visitors who have a communicable disease, or who live in a household in which such a disease is present, must not enter the hospital grounds or buildings.

3. Behaviour by visitors or third parties that harasses or endangers patients, staff or other persons anywhere on the hospital grounds will not be tolerated. The number of visitors present in a patient room may be restricted.

4. Where required, visitors must put on protective clothing before entering a room and wear it until they leave. The doctor or the ward’s nursing staff will issue the relevant instruction.

5. Children under the age of 14 should visit patients only when accompanied by an adult.

6. Visitors must not bring potted plants into patient rooms.

7. Visiting hours are generally Monday to Friday from 3:00 p.m. to 7:00 p.m. and at weekends and on public holidays from 10:00 a.m. to 5:00 p.m. In justified exceptional cases, particularly for seriously ill patients, different arrangements may be agreed with the Ward Manager.

Section 5 Responsibilities and procedure in the event of violations

1. The authority to enforce these House Rules is exercised by the Executive Management, the Medical Director and hospital staff.

2. In the event of a violation of these House Rules, we reserve the right to exercise our authority over the premises and, where necessary, take appropriate action up to and including a ban from the premises.

3. We reserve the right to assert civil claims for damages, particularly where hospital property is culpably damaged.
